Network Terms of Service
TERMS OF SERVICE AGREEMENTThis Terms of Service Agreement hereinafter referred to as (“Agreement”) is by and between The University of Texas Health Science Center at San Antonio (hereinafter referred to as “UT Health”) and UT Health student, staff, faculty, and alumni, (hereinafter referred to as “Participant”).
The purpose of this Agreement is to allow Participants to search for opportunities posted by community organizations as well as register for events, programs, sessions offered by UT Health and community organizations. UT Health makes the information available by accessing its online volunteer management database GivePulse (hereinafter referred to as “UT Health San Antonio ENGAGED”) as a service to Participants.
These terms of service (hereinafter called “Terms”) govern Participant’s access to and use of UT Health San Antonio ENGAGED websites and services (hereinafter called “Services”). Participant shall follow and adhere to the following Terms and Services indicated below prior to using the UT Health San Antonio ENGAGED website.
PROFESSIONAL STANDARDS OF CONDUCT. By consenting below, Participant agrees to: (1) Provide accurate and honest information about his/her education, achievements, and experience; (2) Prepare to the best of his/her abilities and conduct himself/herself professionally as a representative of UT Health; (3) Accept a volunteer position (minimum of one hour per week), internship, or transportation offer in good faith, with the full intention of honoring the commitment. If Participant encounters difficulty during the experiences or cannot honor his/her commitment for any reason, Participant will contact the event’s organizer for assistance; (4) Cancel any volunteer commitment with adequate notice of two business days and notify the community organization, UT Health staff, Transportation staff, and/or faculty as appropriate. If an emergency should arise and Participant is unable to honor his/her commitment, Participant will also contact the abovementioned parties immediately, as applicable. Participant understands that his/her absence impacts others and potentially prevents an opportunity for another Participant.
FAILURE TO COMPLY WITH STANDARDS OF CONDUCT AND POLICIES OF UT HEALTH. UT Health expects Participant to adhere to the above Professional Standards of Conduct and all other relevant and applicable UT Health and partner policies, including but not limited to the UT Health Code of Conduct, UT Health Student Code, UT Health Equal Opportunity and Discriminatory Harassment Policy, UT Health Sexual Misconduct and Sexual Violence Policy, and the UT Health Faculty Handbook. When a Participant fails to comply, it reflects poorly on UT Health, jeopardizes community relationships, and misuses UT Health and community organization resources. Depending upon the severity of non-compliance with the Professional Standards of Conduct, UT Health policies, or partner polices, the following consequences may ensue: 1) Student Conduct charges; (2) Suspension of UT Health San Antonio ENGAGED access; (3) Suspension of volunteer activities supported by UT Health; and/or (4) Required meeting with the appropriate UT Health staff and/or faculty member(s).
OTHER RESTRICTIONS. Participant must not use UT Health San Antonio ENGAGED or its services to: (a) violate any local, state, national or international law; (b) stalk, harass or harm another individual; (c) collect or store personal data about other users; (d) impersonate any person or entity, or otherwise misrepresent your affiliation with a person or entity; or (e) interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Services. Participant must not reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the content, site, or Services, use of the content, site, or Services, or access to the content, site, or Services. Without our prior written consent, Participant may not (a) allow, enable, or otherwise support the transmission of mass unsolicited, commercial advertising or solicitations via e-mail (spam); (b) use any high volume, automated, or electronic means (including without limitation robots, spiders, scripts or other automatic device) to access the Services or monitor or copy our web pages or the content contained thereon; (c) link or deep-link to the site for any purpose; or (d) frame the site, place pop-up windows over its pages, or otherwise affect the display of its pages. All information that Participant provides to UT Health will be true, accurate and current.
UT HEALTH SAN ANTONIO ENGAGED LIMITATION AND RELEASE OF LIABILITY. UT Health makes no representations or warranties regarding the organizations included in UT Health San Antonio ENGAGED and UT Health specifically disclaims any responsibility to investigate or otherwise assess the organizations included in UT Health San Antonio ENGAGED or the nature of the volunteer work involved. The provision of information in UT Health San Antonio ENGAGED does not indicate an endorsement or recommendation of any organization included in UT Health San Antonio ENGAGED by UT Health. It is the responsibility of Participant to exercise his/her own independent due diligence and take all necessary precautions when pursuing and accepting volunteer opportunities, including checking the credentials and integrity of an organization.
By consenting below, Participant hereby releases, indemnifies and hold harmless UT Health, its governing board, officers, representatives, employees, trustees, faculty, host sites and agents from any and all damages, claims, actions, liability and expenses (including costs of judgments, settlements, court costs, and attorney's fees), regardless of the outcome of such claims or actions, arising out of or relating in any way to Participant’s use of UT Health San Antonio ENGAGED or Participant’s volunteer service at any organization included in UT Health San Antonio ENGAGED, except such damages, claims or liability whether contributed to or caused by any negligence of UT Health, its governing board, officers, representatives or otherwise. Participant authorizes the information contained in UT Health San Antonio ENGAGED, including but not limited to, first name, last name, phone number, address, and email address, to be viewed by all persons who will be supervising Participant’s volunteer activities for which Participant has registered, including community organization staff and UT Health administrators.
CONTENT CONSENT AND RELEASE. Participant is solely responsible for any information, comments, feedback, data, materials, photos or other content of any type or description that Participant provides or makes available to UT Health through or to the site or Services, including any data entry forms found through the site Participant’s content, and we act as a passive conduit for the distribution and publication of Participant’s content. However, we reserve the right to remove Participant’s content if we believe Participant may create a liability for UT Health. Participant represents and warrants that he/she (a) does not infringe on any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (b) does not violate any law, statute, ordinance or regulation, including without limitation the laws and regulations governing export control; (c) is not defamatory or trade libelous; (d) is not pornographic or obscene; (e) does not violate any laws regarding unfair competition, anti-discrimination or false advertising; and (f) does not contain viruses, trojan horses, worms, time bombs, cancelbots, spyware, or other similar harmful or deleterious programming routines.
Participant acknowledges and agrees that third parties are third-party beneficiaries of these representations and warranties, and that these representations and warranties shall apply to third-parties with the same force and effect as they apply to Participant. Participant hereby grants to a worldwide, perpetual, irrevocable and royalty-free license, sublicensable through multiple tiers of sublicensees, to use, reproduce, modify, distribute, display, perform, and create derivative works from your content in any media or through any means now known or not currently known. Participant acknowledges that some of his/her content will be publicly available for other users of the site or Services to view, such as feedback and comments. Participant is solely responsible for his/her content.
By registering to participate in a UT Health sponsored event or activity, Participant understands and authorizes UT Health to copyright and publish all photographs and videos in print or electronic format in which Participant appears or speaks that are taken by or for UT Health. Participant affirms that he/she has approval to use any photographs that Participant posts on UT Health San Antonio ENGAGED. Contact UT Health, the event organizer, or the Office of the President at 210-567-2000 with any questions regarding the UT Health San Antonio ENGAGED site.
ACCOMMODATIONS UT HEALTH. UT Health encourages persons with disabilities to participate in volunteering, events, programs, sessions, etc. sponsored by UT Health or its partners. If on-campus or UT Health transportation accommodations are needed please contact the event organizer, at least one week prior to the event. If off-campus accommodations are needed please contact the event organizer at least on week prior to the event. If participating in an event where food and drink will be provided, please contact the event organizer of any dietary restrictions or life-threatening allergies.
DISCLOSURE UT Health. UT Health reserves the right to discontinue any or all Services at any time or to revise the terms and policies of this Agreement. When terms and policies are revised, they will be posted on UT Health San Antonio ENGAGED. These terms and policies will be periodically reviewed to ensure compliance.
TERMINATION. Participant agrees that UT Health, in our sole discretion, may terminate Participant’s UT Health San Antonio ENGAGED membership or other use of the site or services without prior notice, and remove and discard Participant’s content from the site, for any reason and without prior notice, including, without limitation, if UT Health believes that Participant violated or acted inconsistently with the letter or spirit of the Terms. Further, Participant agrees that UT Health shall not be liable to Participant or any other party for any termination of Participant’s access to the Services. Participant may discontinue participation in and access to the Services at any time.
An electronic signature satisfies the signature requirements pursuant to Texas law, therefore, by checking the box on UT Health SA Engagement, I am giving up substantial legal rights I might otherwise have, and that I have signed it knowingly and voluntarily.
